The GTC apply to sports events organised and held by the Service Provider in the territory of Hungary with personal attendance, to group, individual and pair sports sessions, as well as to individual events announced from time to time. Bookings are made through the Minup booking system.
The Service Provider carries out its activity under ÖVTJ code 855101 – sports and leisure education (ÖVTJ being the Hungarian classification of the activities of sole traders).
1. Definitions
1.1. Service Provider: the sole trader identified in this GTC.
1.2. Guest: any natural person who uses the services of the Service Provider or initiates a booking.
1.3. Booking: the ordering of a service offered by the Service Provider through the Minup system or in another manner accepted by the Service Provider.
1.4. Minup system: the online appointment booking and payment system available on the minup.io website and application, operated by a third party, which the Service Provider uses to manage bookings.
1.5. Group session: a sports session organised by the Service Provider and announced for several participants, for which the court is provided by the Service Provider.
1.6. Individual session: a personal service in the course of which the Service Provider acts as a sports partner for one Guest.
1.7. Pair session: a personal service in the course of which the Service Provider provides a sports partner service for two persons.
1.8. Court: the sports court provided by the sports club on which the service is performed.
1.9. Club: the sports club where the service is performed.
1.10. Confirmation: the statement by which the Service Provider accepts the booking and the service relationship comes into existence.
1.11. Cancellation: termination of the booking prior to the booked time.
1.12. No-show: where the Guest does not appear at the booked time and does not use the service.
1.13. Event: a sports programme or event organised by the Service Provider from time to time for a specific occasion, not necessarily in the nature of a session, which can be attended by booking through the Minup system.
2. Acceptance of the GTC
2.1. By using the service, the Guest declares that they have read and understood this GTC and accept its provisions as binding upon themselves.
2.2. If the Guest does not accept this GTC, the service cannot be used.
3. Subject of the service
3.1. The Service Provider organises sports events and provides sports sessions for a fee.
3.2. The main services of the Service Provider are:
- group session,
- individual session,
- pair session.
3.3. In the case of a group session, the Service Provider provides the court and organises the session at the selected club.
3.4. In the case of an individual session and a pair session, the service does not, as a general rule, include the court fee, unless the Service Provider expressly confirms the booking on the basis that it also arranges the court.
3.5. The Service Provider does not provide a stand-alone court booking intermediary service. Use of the court may be an organisational element necessary for the performance of the service, but it does not form part of the Service Provider’s main activity as a separately sold, stand-alone service.
3.6. In addition to the service types set out in the GTC, the Service Provider may also organise individual events announced from time to time (e.g. tournaments, special sports events, open days). These events can be attended by booking through the Minup system, and the general rules of the GTC – in particular those on booking, cancellation, fees and liability – apply irrespective of the nature of the service, in accordance with what the description of the event provides.
4. Booking rules
4.1. Bookings are made in the Minup system, and a booking becomes final upon confirmation by the Service Provider.
4.2. When making a booking, the Guest is obliged to provide accurate data, in particular their name, contact details and any information necessary for the proper performance of the service.
4.3. When making a booking, the Guest must select one of the following service types: group session, individual session or pair session.
4.4. In the case of a group session, the Service Provider provides the court, and cancellation, modification or other administration takes place with the involvement of the Service Provider. For these services the Guest does not manage a separate court booking, but participates in the sports event on the basis of the participation confirmed by the Service Provider.
4.5. In the case of an individual session and a pair session, the booking may take one of two forms:
a) The Guest has their own court booking at the given club. In this case the Guest is responsible for the existence, maintenance, modification and cancellation of the court booking, and the Service Provider provides only the sports partner service.
b) The Guest does not have their own court booking, therefore the Service Provider separately arranges and books the court at the club selected by the Guest. In this case the Service Provider is responsible for the administration of the court booking, including its modification and cancellation.
4.6. In cases a) and b) above, the cancellation conditions of the selected service shall apply to the service at all times. Where the obligation to cancel rests with the Guest, the Guest is obliged to act in accordance with the rules of the club. Where the obligation to cancel rests with the Service Provider, the Service Provider is entitled and obliged to take the necessary steps.
4.7. The Service Provider is entitled to refuse to accept a booking where capacity, the availability of the club, the condition of the participant, the characteristics of the venue or other organisational reasons so justify.
5. Service fees
5.1. The Service Provider publishes the service fees on its website, in the Minup system or on another official information platform.
5.2. The amount of the fees may differ from service to service.
5.3. In the case of a group session, the fee includes both the service and the provision of the court, unless the description of the service provides otherwise.
5.4. In the case of an individual session and a pair session, the fee relates, as a general rule, solely to the sports partner service and does not include the court fee, unless the Service Provider expressly states otherwise.
5.5. Payment may be made by bank card, bank transfer or any other payment method accepted by the Service Provider.
5.6. Payment may be a condition of the booking where the description of the service or the Minup system so indicates.
6. Cancellation and no-show
6.1. The Guest may cancel the booked service free of charge within the deadline set by the Service Provider.
6.2. The deadline for free cancellation is, as a general rule, 24 hours before the start of the service. If the confirmation or the service description relating to the given service contains a different deadline, the deadline set out therein shall apply.
6.3. In the case of a group session, cancellation, modification and refunds are handled by the Service Provider, since the court is also provided by the Service Provider.
6.4. In the case of an individual session and a pair session, the cancellation obligation depends on whether the Guest has their own court booking or the court was booked by the Service Provider:
a) If the Guest booked the court themselves, the Guest is obliged to arrange the cancellation in accordance with the rules of the club.
b) If the Service Provider booked the court, the cancellation is arranged by the Service Provider.
6.5. In the case of cancellation within 24 hours before the start of the service, as well as in the case of a no-show, the Service Provider is entitled to retain the service fee, or to treat the service as performed. An exception applies where the Guest was prevented from participating by an injury resulting from an accident or by illness supported by a medical certificate, provided that the Guest notifies the Service Provider thereof within 48 hours following the time of the service and presents the medical certificate within the same time limit. In such a case the Service Provider shall provide a replacement date agreed with the Guest.
6.6. A cancellation is valid only if it has been made in the Minup system or through the official contact details provided by the Service Provider, and the Service Provider has confirmed it, where this is required by the system or the applicable procedure.
7. Weather and court-related problems
7.1. In the case of an outdoor court, the service may be postponed, modified or cancelled for weather-related reasons if the sports activity cannot be provided safely.
7.2. If the court cannot be used due to the fault of the club, for technical reasons or for any other reason beyond the control of the Service Provider, the Service Provider is entitled to offer an alternative date, to propose another venue, or to cancel the service in whole or in part.
7.3. The Service Provider is not liable for damage arising from weather-related reasons or from an obstacle to the use of the court which is a consequence of the club, the court operator or a force majeure circumstance.
7.4. If the service does not take place on the basis of a decision of the Service Provider, or for weather-related, court-related or any other reason not attributable to the Guest, the Service Provider shall provide, free of charge, a replacement date agreed with the Guest. The replacement date may be used against the service fee already paid by the Guest, without any further payment obligation.
8. Health and liability provisions
8.1. The Guest declares that they are fit, on the basis of their state of health, to use the service, and that they participate in the sports activity at their own risk.
8.2. The Guest expressly acknowledges that the sports activity may involve increased physical strain, collision, falling, strains, sprains, muscle and tendon load, as well as other risks of injury.
8.3. By using the service, the Guest accepts that the Service Provider is not liable for events, injuries, deterioration of health, pecuniary damage or lost advantages falling within the ordinary scope of risk arising from the nature of the sports activity, except where the damage is attributable to the intentional or grossly negligent conduct of the Service Provider, or to a breach of contract attributable to the Service Provider which harms human life, physical integrity or health.
8.4. The Guest acknowledges that a condition of using the service is the appropriate assessment of their own physical condition and state of health, and that any decision in this respect is taken exclusively at the Guest’s own risk.
8.5. The Guest is obliged to inform the Service Provider in advance of any health circumstance that may make participation risky.
8.6. The Service Provider excludes all liability for injuries, accidents and damage caused by the Guest, as well as for any damage arising from the Guest’s improper, negligent, non-compliant conduct or conduct contrary to instructions.
8.7. The Service Provider is not liable for the consequences of the club, the court operator, a third party, another participant, or external circumstances, weather, technical failure, court outage or force majeure, provided that the occurrence of such circumstances and their consequences are not attributable to the Service Provider.
8.8. The Service Provider limits its liability in this GTC to the widest extent permitted by the applicable law. The limitation and exclusion of liability under this GTC does not extend to – and no provision of this GTC may be interpreted as extending to – the Service Provider’s liability for a breach of contract caused intentionally or harming human life, physical integrity or health (Section 6:152 of the Hungarian Civil Code), nor to any liability the exclusion or limitation of which is prohibited by law. Within these limits, the Service Provider is not liable for indirect or consequential damage or for lost profits, and its liability for other pecuniary damage caused by a breach of contract is limited to the amount of the service fee paid for the service concerned.
8.9. Neither the Service Provider nor its contributors are liable for damage arising from the Guest failing to comply with the rules of the club, arriving with inadequate equipment, or concealing their state of health.
8.10. In the course of the booking, the Service Provider expressly draws the Guest’s attention to the provisions of Sections 8 and 9 of this GTC concerning the limitation and exclusion of liability and the assumption of health-related risk. By finalising the booking, the Guest declares that they have become acquainted with these provisions, have understood their content, and expressly accept them.
9. Food and drink service, food allergies
9.1. In the framework of certain events (e.g. tournaments, special events, open days), the Service Provider may also provide food and/or drinks, either itself or by engaging a third party. Such a service is not available at every event, but only within programmes expressly announced by the Service Provider.
9.2. The Service Provider arranges for the provision of food and drinks on an occasional, optional (facultative) basis only, either itself or through a third party engaged by it. The nature of the service (e.g. pre-packaged, generally available foodstuffs, simple catering) and its scope are set out in the description of the event. This service does not qualify as a continuously provided hospitality (catering) service.
9.3. The Guest acknowledges that neither the Service Provider nor the third party responsible for providing the food and drink (e.g. supplier, catering provider) is aware of the Guest’s food allergies or dietary requirements, unless the Guest provides information thereon in advance and in writing when booking the event, in the manner specified by the Service Provider.
9.4. The Guest is obliged to inform the Service Provider – or the partner performing the service, at the contact details specified by the Service Provider – when making the booking, of any food allergy, dietary restriction (e.g. coeliac disease, lactose intolerance, dietary limitation) or other dietary risk which may make the consumption of the food or drink consumed by them dangerous.
9.5. The Service Provider is not liable where the Guest:
a) does not indicate their food allergy or dietary restriction when making the booking;
b) consumes food or drink in respect of the composition or fitness for consumption of which the description of the event or the information provided by the Service Provider stated otherwise;
c) consumes food or drink originating from a third party and not provided by the Service Provider.
9.6. Neither the Service Provider nor the partner engaged by it (e.g. catering provider) warrants that the food or drink provided is safe for every Guest, nor does it guarantee the complete absence of particular ingredients (e.g. gluten, milk, egg, peanuts and tree nuts) or the exclusion of cross-contamination, unless the Service Provider expressly undertakes this in writing in an individual agreement.
9.7. The Service Provider is not liable for any injury, accident, harm to health or medical cost attributable to the Guest having failed to indicate, or having improperly indicated, their food allergy or dietary restriction in accordance with this GTC. This provision does not affect the Service Provider’s liability under clause 8.8 which cannot be excluded by law.
9.8. In respect of food and drink provided by the Service Provider or by a party engaged by it, the Service Provider provides the allergen information required by Regulation (EU) No 1169/2011 on the provision of food information to consumers and by the relevant Hungarian legislation. In the case of pre-packaged food, this information is contained in the manufacturer’s labelling shown on the packaging; in the case of non-pre-packaged food, it is contained in the information provided in advance or on site by the Service Provider or by the partner performing the service. The Guest is entitled to request allergen information prior to consumption.
10. Minor participants
10.1. A minor may participate in the service only where the Service Provider expressly permits this.
10.2. Where a minor participates, the booking is made by the legal representative, and the legal representative is responsible for the minor’s participation and condition, as well as for the acceptance of this GTC.
10.3. Where the description of the service or separate information excludes the participation of minors, the service may be used only by adults.
10.4. The legal representative is responsible for making the declaration on the minor’s state of health referred to in Section 8. Supervision of the minor is provided by the legal representative, except for the period during which, according to the description of the service, supervision is carried out by the Service Provider.
11. Photographs and video recordings
11.1. The Service Provider may take photographs and video recordings at the events.
11.2. A recording on which the Guest appears in a recognisable manner and is individually featured may be used for marketing purposes (on the Service Provider’s website, social media platforms, advertisements and other marketing materials) solely on the basis of the Guest’s prior, express and voluntary consent. Giving consent is not a condition of using the service, and refusing consent entails no disadvantage for the Guest.
11.3. By using the service, the Guest acknowledges that, given the community nature of the event, recordings may be made of them in the background, without being individually featured.
11.4. If the Guest does not consent to being recorded, they must indicate this to the Service Provider in advance. The Guest may withdraw their consent to the making or use of a recording at any time, without giving reasons and free of charge, at the e-mail address hello@deucebudapest.com. Withdrawal does not affect the lawfulness of the use carried out prior to the withdrawal; following the withdrawal, the Service Provider will remove the recording from the platforms managed by it within a reasonable time.
11.5. The prior, express consent of the legal representative is required for the use of a recording made of a minor for marketing purposes.
12. House rules and rules of conduct
12.1. The Guest is obliged to comply with the house rules of the club, the rules of the venue and the instructions of the Service Provider.
12.2. The Guest is obliged to meet the requirements of sportsmanlike conduct and to respect the rights of other participants and of the staff.
12.3. The Service Provider is entitled to refuse or interrupt participation where the Guest’s conduct endangers the safety or order of the service or the peace of others.
12.4. The Guest is obliged to arrive at the venue of the service on time. In the case of late arrival, the Service Provider is not obliged to extend the duration.
13. Data processing
13.1. The Service Provider processes personal data in the course of the booking and the performance of the service.
13.2. The detailed rules on the processing of personal data are set out in the Service Provider’s separate privacy policy.
13.3. By making a booking, the Guest acknowledges that the Service Provider processes the data necessary for the performance of the service, and that the Minup system may participate in the technical handling of the booking data.
13.4. The health data provided by the Guest pursuant to clauses 8.5 and 9.4 (e.g. statements relating to the state of health, food allergy, dietary restriction) qualify as special categories of data under Article 9 of the GDPR. The Service Provider processes such data solely on the basis of the Guest’s explicit consent [Article 9(2)(a) GDPR], for the purpose of the safe performance of the service. The provision of such data is voluntary; in its absence, however, the Service Provider may refuse participation or the use of the food and drink service.
13.5. The operator of the Minup system acts as a data processor in the technical handling of the booking data, and the payment service provider engaged by the Service Provider acts as a data processor in the execution of payments. An up-to-date list of the data processors is set out in the Service Provider’s privacy policy.
14. Complaint handling and enforcement of rights
14.1. The Guest may submit a complaint relating to the service at the Service Provider’s e-mail address hello@deucebudapest.com.
14.2. A complaint made orally at the venue of the service is remedied by the Service Provider immediately where possible. If the Guest does not agree with the handling of the complaint, or if the immediate investigation of the complaint is not possible, the Service Provider takes minutes of the complaint and hands over or sends a copy thereof to the Guest.
14.3. The Service Provider answers written complaints in writing, on the merits, within thirty days of their receipt, and takes measures to communicate the answer. The Service Provider is obliged to give reasons for rejecting a complaint. The Service Provider immediately confirms the receipt of a written complaint submitted by electronic means at the e-mail address provided.
14.4. The Service Provider retains the minutes taken of an oral complaint or the written complaint, as well as a copy of the substantive answer given thereto, for three years, and presents them at the request of the supervisory authority.
14.5. The parties are obliged to settle any disputes primarily amicably, by way of consultation.
14.6. For the out-of-court settlement of a consumer dispute, the Guest may turn to a conciliation board. The board competent according to the Service Provider’s registered seat is the Budapest Conciliation Board (address: 1016 Budapest, Krisztina krt. 99. III. floor 310., Hungary; postal address: 1253 Budapest, P.O. Box 10, Hungary; e-mail: bekelteto.testulet@bkik.hu; telephone: +36 1 488 2131). The Guest may also turn to the conciliation board competent according to their place of residence or stay. The Service Provider has a duty to cooperate in the conciliation board procedure.
14.7. In addition, the Guest may turn to the body exercising consumer protection competence of the government office competent according to their place of residence (kormanyhivatalok.hu), and in the case of a cross-border dispute to the European Consumer Centre (magyarefk.hu), and may also enforce their claim before a court.
15. Consumer rights
15.1. The Service Provider informs the Guest that consumers are entitled to the rights provided for by the relevant Hungarian and EU legislation.
15.2. The Service Provider informs the Guest that, pursuant to Section 29(1)(l) of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, the consumer is not entitled to the fourteen-day right of withdrawal (termination) without giving reasons in the case of a contract for a service relating to leisure activities, where a specific date or period of performance has been stipulated in the contract. The sports sessions and events provided by the Service Provider for a specific date fall within this scope, and the Guest is therefore not entitled to a right of withdrawal in respect of them.
15.3. The Guest acknowledges that, due to the date-bound nature of the service, upon finalisation of the booking the Service Provider begins preparing for performance.
15.4. Clause 15.2 relates solely to the statutory right of withdrawal and does not affect the Guest’s right to cancel under Section 6, nor their right to a replacement date under clause 7.4.
16. Final provisions
16.1. The Service Provider is entitled to amend this GTC unilaterally. The amendment enters into force upon publication on the website or in the Minup system. Bookings already confirmed are governed by the provisions of the GTC in force at the time the booking was confirmed. The Service Provider retains earlier versions of the GTC and makes them available at the Guest’s request.
16.2. In matters not regulated in this GTC, the provisions of Hungarian law shall apply, in particular the Civil Code (Ptk.) and the legislation on electronic commerce services.
16.3. If any provision of this GTC is invalid, this shall not affect the validity of the remaining provisions.
16.4. Date of entry into force of this GTC: 1 August 2026.
16.5. The contract is concluded electronically, by submitting the booking in the Minup system and by the Service Provider’s confirmation. The steps of concluding the contract are: selecting the service, selecting the date, providing the Guest’s data, accepting this GTC and the privacy policy, making payment where applicable, and finally the Service Provider’s confirmation.
16.6. The Guest may correct data entry errors on the interface of the Minup system before finalising the booking. Any error detected after the finalisation of the booking may be reported by the Guest at the Service Provider’s e-mail address, and the Service Provider will arrange for its correction where possible.
16.7. The concluded contract does not qualify as a contract put in writing; it is not filed by the Service Provider and is not subsequently accessible. The data of the booking are available to the Guest in the Minup system.
16.8. The Service Provider has not subjected itself to the provisions of any code of conduct.
16.9. The language of the contract is Hungarian. Where this GTC is also available in a foreign-language translation, in the event of any discrepancy between the Hungarian and the foreign-language version, the Hungarian version shall prevail.
